VA Constitutional Amendments

As of 2/7/26, these 4 amendments have been signed by Governor Spanberger, but must be voted on to be added to Virginia's Constitution.  

VA Constitutional Amendments

In January 2026, the Virginia General Assembly advanced all four of the proposed amendments, and Governor Spanberger signed them all. All 4 of these must be approved by voters.

• Reproductive Freedom (SB449/HJ1): Proposes a constitutional amendment to establish a fundamental right to reproductive care, including abortion, while allowing third-trimester restrictions unless the patient's health is at risk. (Ballot: November 2026)

• Voting Rights Restoration (SJ2/HJ2): Proposes automatically restoring voting rights to ctizens upon release from incarceration for a felony conviction, removing the requirement for executive clemency. (Ballot: November 2026)

• Same-Sex Marriage (HJ3): Aims to repeal the current, invalidated constitutional definition of marriage as only between one man and one woman, replacing it with an affirmative right to marriage for all adult persons. (Ballot: November 2026)

• Mid-Decade Redistricting (HJ4): Passed by both chambers, this amendment allows the General Assembly to redraw congressional districts outside the traditional 10-year cycle if other states do so, effective through 2030. (Ballot: April 2026)

Important: 

• The Mid-Decade Redistricting amendment will be on the ballot on April 21st. 

  • • Early voting period: Friday, March 6 to Saturday, April 18 (no Sunday voting)

• The remaining 3 amendments will be on the ballot on November 3rd.

Voting YES on this amendment is about restoring fairness and leveling the playing field. This redistricting amendment is a temporary measure that will leave Virginia’s bipartisan Redistricting Commission in charge when lines are scheduled to be redrawn in 2031.   In essence, with this amendment Virginia Democrats are asking “voters for permission to counter Donald Trump’s unprecedented race to rig congressional districts” says David M.
